Delta Auto Protect in breach of contract for failure to perform Exton PA

Delta Auto Protect
Fraudulent Vehicle Extended Warranty Company

THE SALE: On a direct phone call with a salesperson, we purchased a "Premier" auto extended warranty policy through Delta Auto Protect (DAP) on 2-17-2017.

OUR FIRST ENCOUNTER: On 12-17-19 (almost three years after purchasing the warranty), we dropped off our car at the dealership for possible repairs and they contacted DAP. On 12-18-19, DAP sent me an email requesting all maintenance records, which I sent that same day.

On 12-19-19, I called DAP and spoke to Justin Turner x408 to make sure my documents had been received. He said they had and that an inspector would be sent out to the Lincoln dealership to inspect the car to see if the repairs Lincoln proposed would be covered. I called the next day to ask when the inspector would be out. He said we had to give them 24-48 hours. The next week, I called back again to check on when the inspector would be out, and was told we had to now give them 7-10 days.

We called on 12-31-19 and spoke to Aaron x 407 who said “apparently there was no inspector available in our area.” Please note we live in the huge metroplex of Dallas Fort Worth, so we knew that wasn’t true. This went on and on, day after day.

I have called and asked for a supervisor and was told there were no supervisors there. On another occasion when I asked for a supervisor, another person got on the phone and as I was explaining the situation to her, she hung up on me.

Another time we were told our claim would be escalated to David Wright x512 in the Authorizations Department and when I asked to speak to him, she said “They don’t take calls.” I asked for his email and emailed him twice with no response.

On January 9th, again we were promised that an inspector would be out on a specific date, and when that day passed, we called again, and given another date. When challenging Nicole Johnson on January 13th about all the agents parroting the same script, yet there was no evidence of progression, she hung up on me.

DAP's LATEST TACTIC: It now seems that our phone number has been flagged, because after we call in and wait the usual 20-25 minutes for someone to answer, we are either promptly put on hold endlessly OR hung up on.

DAP's BREACH OF CONTRACT: DAP is in violation of UCC Section 2-309, which states they have a reasonable time to perform their duties. By contract, they made a promise to perform, and have breached that promise. They have been willful and negligent in their business practices by having no inspector available for over 30 days, with no legitimate reason.

OUR SPECIFIC PERFORMANCE RIGHTS: Pay in full to have our car repaired, give us a refund on the remainder of our service contract, and reimburse us for a rental car for the time our car has been in the shop waiting for their inspector to show up.

Attorney Emily S.B. Fullerton, Schwabe Williamson & Wyatt This attorney is working with our HOA to try to take our home from us because they say it looks too “Mexican” Portland Oregon

This attorney is currently working with the Forest Heights Homeowners Association (FHHOA) in a completely frivolous lawsuit against us. The FHHOA is trying to get us to repaint our home, even though the home is in great repair and looks beautiful.

Unofficially, we have been told we need to repaint because the home looks too "Mexican" and this is of course not a valid reason to repaint a home. This attorney is trying to extort us for fees for work she did not perform.

In the end, this attorney is basically trying to steal our home for us for fraudulent reasons.

This attorney works for the same firm that harassed me when I am pregnant after I spoke out about children being sexually, physically, and emotionally abused. This attorney has been extremely rude, confrontational, and discriminatory against me and my family.

the Nano Ear I paid $139 for a pair of hearing aids from The Nano Ear and never received them. I tried to contact them by e mail and phone but the phone num but the phone number was a non existent number. I also contact Spotify which is who they say

I paid !39 for a pair of hearing aids from the Nano Ear and never received them.  I tried contacting them by e mail, messenger and phone.  The phone number was not in service.  I spoke with Spotify who tracks their product and told them I had never received the hearing aids.

Since they would not return my money even though I asked for the order to be refunded and it was over the 30 day limit, I did not contact my bank.

After reading other reviews on line, I know now that this was an Internet Scam.

CMS / representative’s name was Avis Claiming a I had a refund of a commission check due to me, but had to pay money before releasing it. California

I received a call on January 22 from (415)968-1710,  CA. I was told that I had over $3,000.00 in earnings from commissions on an online store that was set up for me and all I had to do was to pay the past due hosting/maintenance fee for one year, that was just $29.99 per month. My account was on hold due to my card declining over the past year resulting in me owing $359 in fees in order to get the over $3000 commission check released to me, it had to be paid.

I was told by the Rep: Avis that if I pay this by check or money order and send certified or with tracking, and call back with tracking number then they will release my commission check at that time. All they need is the tracking number that the $359 is on its way for them to release the over $3000 to me. She told me I would receive a call from the accounting department to verify everything that we discussed and confirm my email for the invoice to be sent to.

Then I received another call from accounting it was a (866)248-3025 number, the man on the phone verified who I was and then asked me if I chose to continue with my website. I told him NO, he then said rudely, " do you enjoy wasting people's time?", I said no and then he over talked me as I was trying to tell him he was a scam and he said rudely again have fun with collections, and then hung up. I then still went with my gut feeling that this was a scam and researched the phone numbers and found that several other people had reported this.

Mobile Dent Repair/Pauly Mitchell Pauly Mitchell Bad work on car, does not stand behind work/no warranty, unprofessional Frisco TX

Heed my warning, steer clear of this business, had work done on my vehicle, job was terrible (took my vehicle to body shop to get quote on re-work, and they said the work performed on my vehicle was atrocious for someone to claim they have 30 years of experience).

also the owner "Pauly Mitchell" does not warranty his work/stand behind his work, I made several attempts to reach out to him for resolution; he does not return calls, text, voicemails, etc. he claims to have 30 years of experience, from the outcome of work, looks more like 30 days of experience.

Would never do business again, very unprofessional and cannot recommend this business for any type of services.

Dulles Airport Limo Service They did not provide a service I prepaid for. Sterling VA

I prepaid for a car to pick me up from Dulles Airport and take me to an address in Virginia. When the car did not show, I called the company. They told me the car had broken down and they could not get me a timely replacement.

They told me to Uber and that I would get a full refund. That did not happen.  I disputed it with my credit card company, and Dulles Airport Limo Service produced the prepaid receipt as evidence that they did provide the service.

Now they are not responding to calls and emails.  I think this company is a scam.
